These Terms and Conditions (“Terms”) govern use of prehofer.com (the “Website”), a public website featuring mixed-martial-arts and other editorial or promotional content.
These Terms apply only to the public Website. The separate service at app.prehofer.com, including accounts, protected previews, feedback, content calendars, Brand Workspaces, and social-media integrations, is governed by the terms published on that service.

2. Scope
These Terms apply to your use of the Website. The Website’s Privacy Policy and separately published Cookie Policy also apply.
Public pages provide general information about Prehofer, mixed martial arts, media work, and related projects. If a separate written agreement governs services supplied to a client, that agreement takes priority to the extent of any conflict.
3. Permitted use
You may browse the Website and use available contact functions for lawful purposes.
You must not:
- use the Website unlawfully, fraudulently, deceptively, or in a way that infringes another person’s rights;
- introduce malware, disrupt the Website, bypass security, probe for vulnerabilities, or attempt unauthorised access;
- scrape, harvest, or systematically extract Website content without prior written permission;
- reproduce, publish, distribute, or commercially exploit Website content without permission or another valid legal basis; or
- impersonate another person or provide false or misleading information through the Website.
We may limit or block access where reasonably necessary to protect the Website, other users, confidential material, or legal rights.
4. Editorial and mixed-martial-arts content
Website content is general informational, editorial, or promotional material. It is not personalised coaching, medical advice, safety advice, or a substitute for qualified professional instruction.
Mixed martial arts and other combat sports involve an inherent risk of injury. Do not attempt a technique or training activity solely on the basis of Website content. Seek appropriate instruction, use suitable safety equipment, follow the rules of the relevant gym or sport, and consult an appropriate professional where health or fitness concerns apply.
The Website may depict or discuss physical contact, combat-sport activities, or other material that may not be suitable for every child. Parents and guardians should decide whether content is suitable for a child.
5. Intellectual property
Unless stated otherwise, the Website, its design, text, graphics, branding, original photos, videos, and other materials are owned by Sasithon Prehofer, B.Sc. or used under licence and are protected by intellectual-property law.
Guest, athlete, event, platform, and other third-party materials remain the property of their respective owners. No right is granted except the limited right to view material for personal, lawful use or as otherwise permitted by applicable law or express written permission.

6. User communications
You are responsible for material you send through a contact form or by email. You confirm that you have the rights and permissions needed to send it and that it is not unlawful, abusive, defamatory, discriminatory, threatening, infringing, malicious, or deceptive.
Sending an enquiry does not create a client relationship or oblige us to accept a project, publish material, or respond within a particular time.
7. Third-party services and links
The Website may link to or embed services and content that we do not control, including video, social-media, analytics, and other websites. Third-party services have their own terms, privacy practices, availability, and technical requirements. A link, embed, mention, or appearance of third-party branding does not mean that we control or endorse all third-party content.
The service at app.prehofer.com is operated separately from this public Website and has its own terms and privacy policy.
8. Availability and changes
We aim to keep the Website secure and useful, but it is provided on an “as available” basis. We do not promise that it will always be uninterrupted, error-free, compatible with every device, complete, current, or available indefinitely.
We may maintain, update, restrict, suspend, or discontinue all or part of the Website where reasonably necessary, including for security, legal, editorial, technical, or business reasons.
9. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct, gross negligence, personal injury where legally protected, or rights that consumers cannot waive.

- a third-party website, platform, embed, outage, removal, or independent processing;
- events outside our reasonable control; or

Any liability is subject to mandatory Austrian and applicable EU law. Consumer rights remain unaffected.

Our processing of personal data is described in the Website’s Privacy Policy. Current cookie and similar-technology details are contained in the Cookie Policy generated through Complianz.
11. Changes to these Terms
We may update these Terms to reflect changes in the Website, law, or business practices. The current version and update date will be published on the Website. If mandatory law requires renewed acceptance, we will request it before the change applies.
12. Severability and no waiver
If a provision is invalid or unenforceable, the remaining provisions remain effective. For consumers, any invalid provision is replaced only as provided by mandatory law. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
13. Governing law and jurisdiction
These Terms are governed by Austrian law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, to the extent this choice is permitted.
This choice does not remove any mandatory protection provided by otherwise applicable law. Statutory rules determine which courts have jurisdiction; these Terms do not impose a special B2B or B2C place of jurisdiction.
